Teen defendant remains charged with seven felonies as court imposes strict release conditions

ATLANTA — Kroy “KJ” Biermann Jr., the 15-year-old son of former Real Housewives of Atlanta star Kim Zolciak and former Atlanta Falcons linebacker Kroy Biermann, is now out of custody after posting bond in the felony sexual-assault case against him. The teenager remains charged with seven felony counts and has not been convicted.

A grand jury indicted Biermann on charges including aggravated child molestation, aggravated sexual battery, aggravated sodomy, three counts of sexual battery against a child under 16 and false imprisonment. The allegations stem from an April 23, 2026 incident that investigators say occurred in a changing room at a metro Atlanta fitness center.

The major development since SNN.BZ’s earlier report is Biermann’s release. A judge granted a $200,000 bond with unusually restrictive conditions. Local court reporting says he is required to remain at his Alpharetta home, attend school virtually and leave the residence only for approved medical or court appearances.

The order also restricts his contact with minors. Reports on the bond terms say children under 16, including his younger siblings, may not live at or visit the residence while the conditions remain in effect. He is also restricted from using a cellphone or social media.

Prosecutors opposed release and argued that the court should consider potential danger to minors close to the defendant. Defense attorney Jason Sheffield has maintained Biermann’s innocence and has argued that the case should be handled in juvenile court rather than through the adult criminal system.

After bond was granted, prosecutors filed an emergency motion seeking forensic interviews with minor children as part of the continuing investigation and also sought changes to the bond conditions. Those filings indicate that investigative activity continued even after the indictment and bond hearing.

Biermann was arrested in August and initially faced aggravated sodomy and aggravated sexual battery charges. The September grand-jury indictment expanded the case to seven felony counts. Because of the nature of some of the charges, the case entered the adult-court system despite Biermann’s age, though his lawyers have sought a transfer.

The distinction between accusation and proof remains especially important because the defendant is a minor and the alleged victim or victims are minors. An indictment means a grand jury found sufficient basis for the charges to proceed; it is not a finding of guilt. Biermann is presumed innocent unless and until prosecutors prove the charges in court.

As of this update, the case remains pending. The most significant change is custody status: Biermann is no longer being held in the youth detention center, but his freedom is subject to strict court-ordered limitations while the criminal case continues.
