INNOCENT UNTIL PROVEN GUILTY

Why was Andrew Mountbatten arrested?

By Lady Arglwyddes Awbrey

Andrew Mountbatten-Windsor (born Prince Andrew, Duke of York; formerly the second son of Queen Elizabeth II and brother of King Charles III) legally uses the surname Mountbatten-Windsor after being stripped of his royal titles, styles (“His Royal Highness” and “Prince”), and peerages in 2025.

Current Legal Accusation (February 2026 Arrest)

On February 19, 2026 (his 66th birthday), he was arrested by Thames Valley Police at Sandringham Estate on suspicion of misconduct in public office. He was questioned for about 11–12 hours and released under investigation the same evening. No formal charges have been filed; the investigation is ongoing, and the Crown Prosecution Service will later decide whether to charge him.

  • Exact nature of the accusation: While serving as the UK’s Special Representative for International Trade and Investment (a public trade envoy role, 2001–2011), he is suspected of wilfully sharing confidential UK government documents and sensitive official information with Jeffrey Epstein (the late convicted sex offender and financier). This allegedly abused the public’s trust in his official duties, without reasonable excuse or justification.
  • Specific details alleged (based on emails from recently released US Epstein files, January/February 2026):
    • Forwarding official reports from UK trade visits (e.g., to Singapore, Vietnam, Hong Kong, Shenzhen) to Epstein shortly after receiving them in 2010.
    • Sharing “Overseas Bids” files and other trade-related documents.
    • Sending a confidential briefing on investment opportunities in Afghanistan (including Helmand province) and seeking Epstein’s input.
    • Passing a Treasury briefing to a personal business contact (via or involving Epstein).
  • These actions are said to breach confidentiality obligations tied to his public office. The police investigation (including searches at Royal Lodge in Berkshire and Sandringham in Norfolk) focuses on this, not on sexual allegations. He has “consistently and strenuously denied any wrongdoing” and has not publicly commented on these specific claims.

Misconduct in public office is a common-law offence requiring proof that a public officer knowingly misconducted themselves in their duties in a way that amounted to an abuse of the public’s trust.

King Charles III issued a statement expressing “deepest concern” and affirming full cooperation with the investigation, stating “the law must take its course.”

Previous (Historical) Accusations

These are separate civil claims (not criminal charges) related to his Epstein association:

  • Virginia Giuffre (one of Epstein’s trafficking victims) accused him in a 2021 US lawsuit of sexually assaulting/abusing her on three occasions in 2001 when she was 17 (after being trafficked by Epstein and Ghislaine Maxwell). Specific claims included encounters in London (at Maxwell’s home), New York (Epstein’s townhouse), and Epstein’s Little St. James island. She described him as acting “entitled — as if he believed having sex with me was his birthright.” Supporting elements cited: a 2001 photo of them together with Maxwell, flight logs, and payments.
  • He has always denied ever meeting Giuffre, having sex with her, or knowing of Epstein’s crimes at the time. He claimed alibis (e.g., being at a Pizza Express in 2001).
  • The case settled out of court in February 2022 for an undisclosed sum (reportedly ~£12 million) with no admission of liability on his part. He has repeatedly denied all sexual misconduct or knowledge of Epstein’s offending.

Other minor Epstein-file mentions (e.g., a 2010 exotic dancer allegation or additional victim claims) exist but have not led to charges or lawsuits against him.

In summary, the active accusation he was arrested over is the 2010-era misconduct in public office involving alleged leaks of confidential trade/government information to Epstein. The sexual allegations are longstanding, civilly settled, and denied by him. As of February 21, 2026, he faces no convictions or formal charges in either matter.
