McKenna West delivered the infant on Wednesday, August 12, 2026, roughly three weeks before her expected due date of September 2. The baby was diagnosed at about 20 weeks of pregnancy with hypoplastic left heart syndrome (HLHS), a condition in which the left side of the heart is underdeveloped and requires a series of staged surgeries beginning shortly after birth to support circulation.
West had entered a surrogacy agreement with Nausheen Gilkar and Omar Ahmed, a California couple. According to court filings and statements, the agreement included provisions addressing fetal anomalies. After the HLHS diagnosis, West declined a request from the couple to terminate the pregnancy. She later relocated from Alaska to Texas for prenatal care and delivery, selecting hospitals experienced in treating the condition. The intended parents pursued legal action in California seeking to establish parentage and influence the location of care and delivery. They have referred to the child as Rumi; West has called him Gabriel.
Texas Attorney General Ken Paxton’s office intervened as the birth approached. A Dallas County court issued an emergency order requiring medically indicated stabilizing and life-sustaining care after birth, prohibiting the withholding or obstruction of necessary treatment, and restricting removal or transfer of the child from Texas while proceedings continued. The order did not restrict West’s own medical decisions during pregnancy.
Following the birth, the newborn was placed in the physical custody of Gilkar and Ahmed and is receiving specialized care at a tertiary medical center in the Dallas area, according to statements from their attorney, Lee Budner. West has been barred from contact with the infant under existing orders. Her attorney, Lincoln Wilson, has said she intends to challenge the parentage determinations, arguing that Texas law recognizes the woman who gives birth as the mother, and that the matter could be pursued through higher courts if necessary.
HLHS typically requires immediate surgical intervention after birth, followed by additional procedures in infancy and childhood. Survival rates through the first year with treatment are reported in the range of roughly 20 to 60 percent, depending on the source and individual factors, and many survivors face ongoing medical needs that can include further interventions, medications, and activity limitations later in life. Some children eventually require heart transplantation.
The surrogacy agency that matched the parties, Worldwide Surrogacy Specialists, has stated it supports both the gestational carrier’s right to make decisions about her own body and the intended parents’ claim to legal parentage after birth. Attorneys for both sides have emphasized the priority of the infant’s medical care while the legal questions of custody and parental rights remain unresolved. A further hearing in the Texas proceedings was anticipated later in August.
The case highlights the intersection of surrogacy contracts, differing state laws on parental rights and medical decision-making, and the practical challenges of caring for a newborn with a complex congenital condition across jurisdictional lines.
