Opening Statements and Evidence: The trial opened with prosecutors presenting disturbing video evidence, including cellphone footage and bus dashcam recordings, showing Ihsan choking Fatima and the subsequent intervention by students and Wagner. Bus driver John Denicola testified, describing the scene as chaotic, with Fatima in distress and Ihsan unresponsive to attempts to stop him.

He noted her eyes rolling back, indicating she was unable to breathe. Prosecutors emphasized the severity of the attack, supported by witness accounts and Fatima’s hospital stay for neck, throat, and jaw injuries, which required four days of treatment.

In addition to blurring the images so that the innocent are not seen, the court most foolishly decided that the trial cannot use the expression “honor killing.” This is not the court. This crime will be referred to as “honor killing.”



Defense Strategy: Ihsan’s attorney, Erik Kaeding, argued that witness accounts may lack credibility due to the chaotic nature of the incident, urging jurors to focus on video evidence over conflicting testimonies. The defense also pointed to Fatima’s boyfriend as a possible instigator, though details remain vague. Zahraa’s attorney, Tim Leary, highlighted her limited English proficiency, suggesting she may not have fully understood the restraining order she violated, which barred her from the school after a prior incident in September 2024 involving the boyfriend.

Judicial Rulings: A significant ruling by the court prohibited mention of the alleged arranged marriage as the motive, potentially complicating the prosecution’s ability to establish intent. This has raised questions about how motive will be addressed, with prosecutors relying on witness testimonies and Fatima’s statements about her father’s threats.



Witness Testimonies: In addition to Fatima, witnesses include her boyfriend, who suffered a “boxer’s fracture” and facial injuries while defending her, and classmates who intervened. Josh Wagner testified about restraining Ihsan until police arrived, and Officer Sophal Heang’s bodycam footage showed Ihsan’s arrest, with him demanding to speak to Fatima and claiming she would return home if he asked. The prosecution plans to call school officials to testify about prior incidents, including Zahraa’s ban from campus.

Court documents and Fatima’s statements to police reveal a history of alleged abuse, with Ihsan threatening her life for dating her boyfriend and refusing the marriage. Zahraa’s actions post-incident included attempting to flee to Canada with her younger children (aged 3 and 5), where she was arrested on October 22, 2024, at the border. Ihsan was initially released on a $150,000 bond on October 24 but re-arrested on November 5 after attempted murder charges were added, with bail raised to $1 million. Zahraa’s bail remains at $500,000.
