Exactly, it was first created to prosecute extremely powerful organized crime syndicates, i.e., the Mafia. Like you said, the real menaces to society that controlled entire cities and had elected government officials on payroll. Basically, it allowed prosecutors to charge the higher ups for the various crimes committed by their Lackys without any solid proof that orders were given.
It was written to be purposefully ambiguous regarding what actually classifies as organized crime, and who actually classifies as an affiliated individual, being completely up to the discretion of the prosecutors to allow them as much leeway as possible. Suddenly, courts could charge anyone they considered to be the “boss” with any crime that a lower-level associate commits, based on the assumption that they were following orders given by higher ups, and the once nearly immune mob bosses were eating life sentences left and right.
Now if when we’re talking about the Mafia who were equally or more powerful than the damn cities trying to fight them, it makes sense why they took extreme measures that basically allowed prosecuters free reign to bend the law and sidestep the tradional judicial process when judges and jury were getting kidnapped and murdered faster than they could be replaced. But now these same extreme measures are being used against rappers or poor kids from the hood.
Any group of friends with a cool name for their group can be considered a criminal orginization equal to the mafia if one person in it commits a felony, in the eyes of the court. I’m not going to debate what YSL really is or what they’ve done because we don’t know, simple as that. What we do know is that they are no where near the old Mafia families that were capable of owning entire police departments, and YSL still closer to being a gang than most other groups that get hit with ricos in ATL.
There’s a reason those cases get dragged out for so long too, it’s to drain the defendant of all of their money in legal fees before they can even get to a fair trial. Thug is probably one of the few actually wealthy enough to be able to afford lawyers long enough to his fair chance in court, and it was designed to take down people with 10 times his wealth and influence.
You can see all throughout this case how they were just fucking around and wasting time because they didn’t have sufficient evidence, that’s why they were so desperate to get that Woody dude to admit to something that he did, anything so they could use that against Thug since Woody was an affiliate, and Thug is the “boss”, but it of course failed in a hilarious fashion.
The reasons Atlanta does all this are complicated, it’s rooted in racism and can be traced back directly to slavery. The private prison industry is one of the most profitable in the world, and Georgia has the highest incarceration rates per capita than anywhere else in the world, meaning private prisons are Georgia’s most important industry, their cash cow, and the one that has the most influence over Georgia’s internal politics.
You can put two and two together and see how there is a vested fiscal interest in being “tough on crime”, and making sure inmate quotas stay right where they need to be, nice and full. Then we have the 13th amendment, which made slavery illegal except for those convicted of a crime and currently serving time for it. We also know that institutionalized slavery was the most profitable industry in the history of mankind.
We can’t forget that in the entire scope of human history, it wasn’t all the long ago when the state of Georgia were big big fans of slavery. So much so that they started a war once it was banned, and that history can be pretty easily traced all the way back to what we’re talking about now. All those wealthy plantation owners didn’t just disappear, they just found other barely-legal ways to dehumanize and enslave black people while extracting as much wealth as possible. Let’s just say their penchant for slave labor is still alive and well today, thriving even, thanks to the rico act and Georgia having the most amount of juveniles serving life sentences in the world.
The institution of white supremacy requires the never-ending dehumanization of black folk in order to funtion properly. Think about the “well did they deserve it” and “blacks do commit more crimes” crowd. And it isn’t just used exclusively against Black people, look at how Mexican, Chinese, and Arab people are treated in America too. That’s the intentional social conditioning at work. There’s no way in hell I could ever be convinced that literal children having to spend their entire lives behind bars as literal slaves is in any way justifiable.
